Your Statutory Rights The contents of our terms and conditions detailed below do not affect your statutory rights in any way. We reserve the right to change any of the contents of any part of this site, including these terms and conditions, at any time and without notice. Delivery Area We despatch to most parts of the UK. Dispatch days are Monday to Thursday and delivery is usually next working day. Please call us on 07791 378503 to confirm delivery on a specific date. Pricing Policy We make every effort to ensure that the prices within our website are correct. Our prices will vary according to weather, seasonality and supply. You are advised to check the prices of our oysters on this website before placing an order. Payment Due to the fact Cornish Native Oysters are a fresh live oyster, gathered using 500 year old methods aboard a vessel without machinery and in unpredictable weather conditions we cannot offer any sale or return, credit or payment on account terms, payment in full is required before order is dispatched. Cornish Native Oysters .co.uk uses PayPal for Secure Online Trading to protect your credit card information and assist your shopping experience. However, any losses incurred or sustained by customers who transmit information by means of email or other Internet links shall be borne solely and exclusively by that customer and in no event shall any such losses in whole or in part be borne by Cornish Native Oysters .co.uk. When using a public computer, you must sign out when you have finished shopping. If you discover that goods have been ordered using your credit card by someone not authorised to do so, Cornish Native Oysters .co.uk will refund to you the money it receives provided that: (a) you inform your credit card company and Cornish Native Oysters .co.uk of the unauthorised purchase as soon as you discover it; and (b) you co-operate with your credit card company Cornish Native Oysters .co.uk and, if necessary, the police in relation to the unauthorised use. Once PayPal has debited your card we process the order. Your order should not have been debited if there are no oysters available. In the unlikely event of limited supply, or bad weather this may not be on the day intended, however we will endeavour to dispatch within 24hrs of full payment. We will require the postal code of where the credit/debit card is registered to. Should we not be able to collect payment for reasons outside of our control, we will not dispatch your order. Should this happen we will make every effort to contact you and advise you, however we accept no liability for any loss incurred due to the delay in dispatching your order. Delivery Cornish Native Oysters guarantee next day dispatch following our confirmation email, which is usually the day you order. In the unlikely event that you have not received all the goods within 7 days of the date of order (or where you have requested a delayed despatch within 7 days of the requested despatch date), you must notify us immediately. Availability While we endeavour to hold sufficient stock to meet all orders, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we may, at our discretion, supply or deliver a substituted product, delay delivery until the product is in stock, or refund you the price paid for such goods as soon as possible and in any case within 30 days. If such substitution, delay or refund needs to take place, your agreement to the same will be requested by email or telephone immediately. Accuracy of delivery details You are responsible for giving us a full and correct address for all deliveries, including but not limited to the postcode. If our carriers are unable to deliver any order due to any error in the address, you will be charged for the order in full. Should you ask for your order to be left in a specific place (for example a garden shed or in your porch) and the carrier cannot obtain a signature to confirm the delivery of your order, it will be left at your own risk, we accept no liability for its loss or damage. Our Guarantee We aim to supply oysters and products of the highest standard, if you are not happy with the quality of our oysters and products, we will refund your money by the same method as payment was received. Whilst we make every effort to remove all loose shell etc. from your order, please check thoroughly that there is none in the in the oyster as no liability will be accepted by the company for any injury or loss as a result of these items. Return of Non-perishable Items If you wish to return a non-perishable item for any reason other than it not being of merchantable quality, you may do so at your own expense. We will refund the cost of the item less a handling charge of 10 per cent, as long as the item is returned to us in the same condition as when we sent it to you. Cancellation of orders You may cancel your order at any time up to the 8am on the day of dispatch. Any order that has been sourced specially for you (by prior agreement) will be charged for in full. If we are subsequently able to sell all or part of those items sourced specially we undertake to credit you in full for the value of those items. Force Majeure We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes).
